These Terms & Conditions govern access to and use of the SAMWAD platform, owned and operated by Arpneet AI Technologies Private Limited.
1. Acceptance of Terms
By accessing or using the SAMWAD platform, you agree to be bound by these Terms & Conditions, along with our Privacy Policy and any additional guidelines or policies published by SAMWAD.
If you do not agree, you must not access or use the Services.
2. Definitions
- “SAMWAD” refers to the WhatsApp Business API platform operated by Arpneet AI Technologies Private Limited.
- “Client” refers to any business entity or authorized representative using the Services.
- “End User” refers to individuals communicated with by the Client using WhatsApp.
- “Services” includes messaging, automation, dashboards, analytics, AI features, and related tools.
3. Nature of Service
SAMWAD is a technology platform that enables Clients to communicate with End Users using the official WhatsApp Business API.
4. Account Registration
Clients must provide accurate and complete information while registering and are responsible for maintaining the confidentiality of account credentials.
SAMWAD reserves the right to suspend or terminate accounts with false, misleading, or incomplete information.
5. Client Obligations
- Obtain all necessary permissions and consents from End Users
- Ensure message content is lawful and compliant with WhatsApp policies
- Use the Services only for legitimate business communication
- Comply with applicable laws and regulations
SAMWAD does not verify Client consent or message legality.
6. WhatsApp Charges & Pricing
WhatsApp message charges are levied directly by Meta Platforms, Inc. as per their prevailing pricing policies.
7. Prohibited Use
- Spam or unsolicited messaging
- Fraud, harassment, or deceptive practices
- Violation of privacy, intellectual property, or data protection laws
- Any activity that may harm SAMWAD, WhatsApp, or End Users
SAMWAD reserves the right to suspend or terminate access for violations without prior notice.
8. AI & Automation Disclaimer
AI-powered features are provided for assistance and efficiency only. Outputs may not be accurate, complete, or suitable for all use cases.
Clients remain solely responsible for decisions, content, and actions taken using AI-generated outputs.
9. Service Availability
SAMWAD aims to provide reliable service but does not guarantee uninterrupted or error-free operation.
Downtime may occur due to maintenance, third-party outages, or force majeure events.
10. Limitation of Liability
To the maximum extent permitted by law, SAMWAD shall not be liable for indirect, incidental, or consequential damages, including loss of business, revenue, or data.
11. Termination
SAMWAD may suspend or terminate Services for violations of these Terms or misuse of the platform.
Upon termination, Client data may be deleted after a reasonable retention period unless legally required.
12. Intellectual Property
All platform software, branding, designs, and content belong to SAMWAD. Clients retain ownership of their own data and message content.
13. Indemnification
Clients agree to indemnify and hold harmless SAMWAD against claims, penalties, or losses arising from Client misuse, unlawful messaging, or consent violations.
14. Governing Law & Jurisdiction
These Terms shall be governed by the laws of India. Courts located in Noida, Uttar Pradesh shall have exclusive jurisdiction.
